The Quate application and website(s) [hereinafter referred to collectively as "Quate", “quate”, "the web application" or “the website”] are owned and operated by Altite Corp and its corporate affiliates and/or assignors [hereinafter referred to collectively as “we" or "the Company"]. By registering for, accessing or using the web site(s) or application at www.quate.com www.lifearenas.com or other domains or mobile versions thereof [hereinafter referred to as "Site" or “application”] you [hereinafter referred to as "User"] acknowledge that you are over the age of 13, have read, understand and agree to be bound by these Terms of Service ["Terms of Use" or "Agreement"), whether or not you are a registered user.. Material in this website are either owned or copyrighted by Altite, their advertisers and/or by others. All electronic images, virtual tours and video are for viewing purposes only. Communications & Privacy

Any text, image, material, information, form, or e-mail (hereinafter referred to as “INFORMATION”) user adds, retrieves, modifies or stores in Altite's database as part of the web application shall be deemed Confidential to the extent permitted by federal, state, local and/or international law and the web application security and shall be deemed the property of the user, except that statistical information regarding the number of times a particular Arena, Emotion and/or combination thereof is chosen may be accumulated by Altite and shall be the sole property of Altite. It is understood that such statistical information will not be stored in a manner as to be associated with an individual user. Any Information transmitted or provided to any advertisers, businesses or organizations on the website by any means will be considered NON-CONFIDENTIAL and NON-PROPRIETARY. Altite shall not disclose any information contained in its databases (except as to statistical information described above), to third-parties without your written or verbal consent, except that Altite may disclose such information as is required by law, including by subpoena, court order or lawful request of a governmental or law enforcement agency. User agrees not to transmit or provide to and/or through Altite at this domain and/or other domain, Altite advertisers on website, businesses listed on website and/or this website and/or Altite databases any unlawful, threatening, libelous, defamatory, obscene, pornographic or otherwise offensive information.

No Unlawful or Prohibited Use

As a condition of your use of website, user warrants and represents that you will not use the website for any commercial purposes or for any purpose that is unlawful or prohibited by these terms. Furthermore, User specifically agree not to use this website to solicit the businesses listed and/or advertised on this website for any commercial and/or fund raising purpose. In addition, user agree not to use the website in any manner that could damage, disable, overburden, or impair the website or interfere with another person's use and enjoyment of the website. Indemnity

User agrees to indemnify and hold harmless Altite its directors, officers, employees, agents, hosts, vendors, advertisers, and clients from any claim arising from (i) your use of website, or (ii) violation of the terms and conditions of the use of this website or (iii) your violation of any law or (iv) your violation of the rights of any third party.

Liability Limitation

User Representation

User represents, warrant and covenant that (a) you have the power and authority to enter into this agreement; (b) you are at least 18 years of age; and, (c) YOU will only use the website in accordance with the terms and conditions contained herein.

Severability

Should any provisions of this Agreement be held by a court of law to be illegal, invalid or unenforceable, the legality, validity and enforceability of the remaining provisions of this Agreement shall not be affected or impaired thereby. 

Waiver

The waiver by Altite of a breach of any provision of this Agreement by you shall not operate or be construed as a waiver of any other or subsequent breach by YOU.

Scope of Agreement

This website User Agreement constitutes the entire agreement between Altite and the user, and supersedes any previous agreements on this subject. If any part of this agreement is found to be unenforceable for any reason, all other parts of this agreement shall remain in effect. Any non-enforcement of this agreement by Altite Corp. shall not be considered a waiver of rights. The laws of the State of New York shall govern this agreement. The State of New York is the exclusive jurisdiction for disputes. Venue for any disputes will be in State court in Orange County, New York or Federal Court located in White Plains, New York.
